Agreement to terms
These terms govern your access to and use of the Close Whisperer private beta. By using the beta, you agree to these terms and to any written beta conditions provided during onboarding.
If you use Close Whisperer for an organization, you confirm that you have authority to accept these terms for that organization.
The beta service
Close Whisperer is an actively developing sales coaching product. Beta features may be incomplete, unavailable, changed, or removed. We may limit access while we test and refine the service.
Core in-call coaching may include script cues, communication-style guidance, objection prompts, and suggested next moves. Post-call coaching, performance insights, and manager visibility are planned and may not be available.
Acceptable use
You may not use Close Whisperer to break the law, violate another person's rights, mislead meeting participants about legally required notice, access systems without permission, interfere with the service, or attempt to extract protected product code or models.
You may not use the service to harass, discriminate, facilitate fraud, or process content that you do not have the right to use.
Your responsibilities
You are responsible for your calls, your conduct, your account, and the content you provide. You must follow your company policy and the recording, consent, employment, and privacy laws that apply to you and every meeting participant.
Close Whisperer provides coaching suggestions. You remain responsible for your statements, decisions, commitments, and sales practices.
Intellectual property
Close Whisperer and its software, brand, design, and related materials are owned by Close Whisperer or its licensors. These terms give you a limited right to use the beta during your authorized access, and do not transfer ownership.
You retain rights in content that you provide. You grant us the limited rights needed to process that content to operate, secure, support, and improve the service, subject to applicable law and our privacy policy.
Disclaimers
The beta is provided as available and without a guarantee that it will be uninterrupted, error free, or suitable for every sales process. Close Whisperer does not guarantee sales results, revenue, conversion, or any other business outcome.
Coaching cues are suggestions and may be incomplete or incorrect. You should use your own judgment before acting on them.
Limitation of liability
To the extent permitted by law, Close Whisperer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the beta.
Any liability that cannot be excluded will be limited to the amount you paid for the beta during the three months before the event giving rise to the claim, or one hundred United States dollars if you paid nothing, except where the law requires a different result.
Changes
We may change the beta or these terms as the product develops. We will post updated terms here and may provide additional notice when a change is material. Continued use after the effective date means you accept the updated terms.
